Terms & Conditions

1. Terms & Conditions Clause

Vendor Information & Business Name Protection Agreement

By checking the agreement box at checkout, Customer expressly agrees to be bound by the terms set forth in this Section, and this Agreement shall thereupon become immediately binding and enforceable against Customer.

1.1 License Grant. Vendor Information is licensed to Customer for personal use. Customer may buy hair from the identified vendor and resell it without restriction from Company.

1.2 Prohibited Conduct. Customer shall not share, forward, screenshot, post, publish, or distribute the Vendor Information in whole or in part, to any person, group, or platform  while identifying, labeling, tagging, or associating it with "Mochawest," "LBUVendors," "Let's Bundle Up," or any variation or misspelling of these names. This applies whether the distribution is for sale or free, private or public, and whether or not Customer profits. There are no exceptions.

1.3 Liquidated Damages. Customer agrees, by checking the agreement box at checkout, before any breach occurs, that $10,000 per occurrence is the amount owed to Company if Customer violates Section 1.2. This number is fixed now, at the time of purchase, because the reputational and business harm this conduct causes is genuine and cannot be precisely measured after the fact. Customer is not agreeing to this after being caught. Customer is agreeing to it by accepting these terms. Upon breach, Company will pursue this amount through demand, settlement, or legal action, and where necessary, a court will enter judgment confirming and enforcing that amount.

1.4 Injunctive Relief. Company may also obtain a court order requiring Customer to stop distribution and remove any existing posts, in addition to the $10,000 owed under Section 1.3.

1.5 Governing Law & Venue. This agreement is governed by North Carolina law. Disputes shall be brought in the state or federal courts of Durham, North Carolina, including North Carolina Small Claims (Magistrate) Court where the claim qualifies.

1.6 Survival. This section applies indefinitely to all Vendor Information disclosed to Customer, regardless of when the breach occurs.

1.7 Attorney's Fees. If Company must take legal action to enforce this section and prevails, Customer will reimburse Company's attorney's fees and court costs.

1.8 Acceptance. Checking the agreement box at checkout constitutes Customer's binding acceptance of this entire section. Accessing the file containing Vendor Information after checkout further confirms that acceptance.
